Permitted Development Rights Explained for London Homeowners

Permitted Development (PD) rights allow homeowners to carry out a range of improvements without applying for planning permission. They're frequently described as if they're a simple on/off switch — you either have them or you don't. The reality is more nuanced, and misunderstanding the rules can lead to unlawful development.

What Permitted Development Actually Means

Permitted Development rights are a nationally defined set of development permissions granted by the government through the Town and Country Planning (General Permitted Development) (England) Order 2015 (GPDO). They allow specific categories of development — to specific size, height, and location limits — to proceed without a local planning application.

Crucially, PD rights are not unconditional. Each category of PD right comes with conditions and limitations. Development that exceeds the limits is not permitted — it requires a full planning application, regardless of how similar it looks to something that would be permitted if slightly smaller.

The Main PD Categories for Homeowners

Class A — Enlargements, improvements, and alterations to a dwellinghouse. This covers rear extensions (most commonly used), side extensions, and roof alterations. The limits for rear extensions are 3m behind the original rear wall for attached houses, 4m for detached houses (standard PD), or up to 6m/8m under the Larger Home Extension Scheme (subject to neighbour consultation). Side extensions must not exceed half the original width of the dwelling and must be single-storey (under 4m).

Class B — Roof additions. Covers dormer windows and additions within the existing roof slope. Cannot be on the principal elevation (the front of the house). Size limits apply and vary depending on roof type.

Class C — Any other alterations to the roof. Covers rooflights and solar panels subject to limitations on protrusion and location.

Class E — Outbuildings and extensions within the curtilage. Covers garden buildings, sheds, home offices, and garages within the garden. Must be single-storey, cannot cover more than 50% of the curtilage (excluding the original house footprint), and must be behind the principal elevation.

When PD Rights Are Removed or Restricted

Conservation areas. In a conservation area, PD rights for certain works are restricted. Notably, rear and side extensions on the principal elevation, cladding of external walls, and satellite dishes are not permitted under PD in a conservation area. Rear single-storey extensions are permitted within limits, but must not extend beyond the rear wall of the original house more than specified amounts.

Article 4 Directions. Local authorities can remove PD rights in specific areas by making an Article 4 Direction. This is common in conservation areas (extending the restrictions beyond those already in place nationally) and in some areas designated by the council for specific reasons.

Previous planning conditions. If the original planning permission for the house included a condition removing PD rights — common on new developments built since the 1980s — then none of the works covered by those conditions can be carried out under PD.

Flats and maisonettes. Residential PD rights apply to houses only. Flats and maisonettes have no PD rights under the household categories. Any external alterations require planning permission.

Lawful Development Certificates

A Lawful Development Certificate (LDC) from the local planning authority confirms in writing that a proposed or completed development is lawful — either because it's within PD rights or because it's not development at all. An LDC is not the same as planning permission, but it provides legal certainty and is the document your solicitors will ask for when you sell. For any PD works, particularly on a property you intend to sell, an LDC is strongly advisable.
