What Is the JCT Homeowner Contract?

The JCT Homeowner Contract is a standard form building contract published by the Joint Contracts Tribunal, specifically designed for use between homeowners and building contractors on residential renovation, extension, and refurbishment projects. Unlike the more complex JCT standard forms used on commercial and larger residential schemes, the Homeowner Contract is written in plain language and is intended to be accessible to non-professionals.

The JCT (Joint Contracts Tribunal) publishes a suite of standard contract forms that are widely used across the UK construction industry. The Homeowner Contract is the simplest and most accessible of these, designed for projects where there is no separate consultant contract administrator — the homeowner and contractor deal directly with each other.

What Does the JCT Homeowner Contract Cover?

The contract sets out the agreed scope of works, the contract price, the payment schedule and payment method, what happens if either party wants to vary the works, the contractor's obligations regarding quality and programme, provisions for practical completion, defects liability, and what happens in the event of disputes.

A key feature is the inclusion of a schedule of works or specification document as a contractual attachment, which defines exactly what is to be built. The quality of this schedule is critical — a vague or incomplete schedule of works creates ambiguity that can lead to disputes about what is and is not included in the price.

Key Protections for Homeowners

The JCT Homeowner Contract includes several important protections. The contractor is required to carry out the works in a proper and workmanlike manner using good quality materials. There are clear obligations around notifying and agreeing variations before they are carried out, rather than the contractor simply presenting additional charges at the end. The defects liability provisions require the contractor to return and fix defects that appear during a defined period after completion, at no additional cost. Payment terms are clear, and the contract limits the contractor's right to claim additional payment for unforeseen circumstances.

When Should You Use It?

The JCT Homeowner Contract is appropriate for most straightforward residential projects where the homeowner is dealing directly with a contractor without a professional contract administrator. This includes extensions, loft conversions, refurbishments, and significant improvement works. It is less suitable for very large or complex projects where a more detailed contract form (such as JCT Intermediate or JCT Minor Works) and a professional contract administrator would be more appropriate.

Even for smaller projects, having a written contract is strongly advisable. Disputes between homeowners and contractors — about what was included, how much was agreed, and who is responsible for defects — are significantly more common and more difficult to resolve when there is no written contract in place.

Should You Always Use a Standard Form?

Standard form contracts like the JCT Homeowner Contract have been developed and tested over many years and provide a balanced set of terms. Be cautious about bespoke contracts produced by contractors that heavily favour their own position — for example, by removing defects liability clauses, limiting the contractor's obligations, or expanding their right to claim additional payment. If a contractor presents you with a contract that looks very different from a balanced standard form, it is worth taking independent legal advice before signing.
