The Joint Contracts Tribunal, commonly known as JCT, publishes a range of standard form construction contracts that are widely used in the UK construction industry. For smaller projects such as residential extensions, refurbishments, and minor works, the JCT Minor Works Building Contract is one of the most commonly referenced forms. Understanding what it covers and whether it is appropriate for your project is useful before entering into any building contract.
The JCT Minor Works contract is designed for projects where the works are straightforward, the employer does not require detailed control over the work, and the project value is typically below one to two million pounds, though this is a guide rather than an absolute limit. It sets out the obligations of both the employer, who is the client, and the contractor, as well as the roles of the contract administrator, which is typically the architect or project manager who administers the contract on behalf of the client.
Key provisions of the Minor Works contract include the agreed contract sum, the start and completion dates, the payment provisions including the frequency and timing of interim valuations, provisions for dealing with variations to the agreed scope, mechanisms for dealing with defects after practical completion, insurance obligations on both parties, and the process for resolving disputes.
For smaller domestic projects where there is no formal contract administrator, a simpler domestic subcontract or a purpose-written agreement may be more appropriate than a full JCT form. JCT contracts are designed to be administered by a professional, and using one without understanding the administrative requirements can create confusion.
The most important protection any building contract provides, regardless of its form, is a clear written record of what has been agreed, what the price is, how payment will work, and how changes will be handled.
